Correction to Ruling Number N022266 Dear Mr. Ryu: This replaces Ruling Number N022266, dated February 14, 2008, which was based on a sample that was subsequently modified. A complete corrected ruling follows. In the original version the product was described as follows: Style 8321-5120 is a men’s shirt, in size Large, constructed from an outer shell of 100% cotton, yarn dyed, plaid flannel fabric with a full lining of 100% polyester, quilted woven fabric with non-woven fiberfill batting. Style 8321-5120 has a left-over-right full front opening with six button closures; a spread collar; a jersey knit hood sewn to the inside of the collar; a drawstring closure on the hood; long vented sleeves with a button on the vent and a one button closure on the cuffs; two patch pockets on the chest with flaps secured by a one-button closures; side seam pockets below the waist; two side seam vents; and a straight, hemmed bottom. The corrected sample has an elasticized drawstring threaded through the bottom hem with a cord lock. In the case of garments possessing features commonly associated with both shirts and jackets Customs and Border Protection will use the Informed Compliance Publication (ICP) “Apparel Terminology under the HTSUS” for guidance. Generally, garments having three jacket features listed in the “Shirt-Jacket” portion of the ICP will be classified as jackets, unless the result is unreasonable. In this case the garment has a full lining, pockets at or below the waist and a tightening at the bottom hem, all of which are jacket features. Consequently, the revised sample is classifiable as a jacket. The applicable subheading for Style 8321-5120 will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles, of cotton. The duty rate will be 9.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Style 8321-5120 falls within textile category designation 334. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
