Box 90595 Los Angeles, CA 90009 RE: The tariff classification of a rug from China Dear Mr. Thompson: In your letter dated March 5, 2008 you requested a classification ruling on behalf of G.A. Gertmenian & Sons. The submitted sample, described as Design #G11556 “Snow Much Fun” #S11780, is a rug. The face of the rug is made from nylon yarns. The yarns have been tufted into a pre-existing base. It features a plastic foam anti-slip backing. The face of the rug is printed with a snowflake pattern and the semi-circular rug measures approximately 31 x 55.5 inches. The applicable subheading for the rug will be 5703.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, tufted, whether or not made up: of nylon or other polyamides: other… measuring not more than 5.25 m2 in area. The rate of duty will be 6.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The rug falls within textile category 665. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
