Dear Mr. Gleim In your letter dated February 20, 2008, you requested a tariff classification ruling. Sample is being returned as requested. The submitted sample is a portable, battery-operated FM radio with an air-band scanner. This radio, which measures approximately 2 ¾ inches high by 4 ¼ inches wide by ? inch deep, incorporates a telescopic antenna, a digital clock, a speaker, various control and input buttons, and a textile lanyard for carrying and hanging. This apparatus, which is valued not over $40 each, is not designed for motor vehicle installation.
