The sample which you submitted is being retained by this office. A style number was not provided for the sample submitted. The item is a cell phone holder constructed with an outer surface of 100% knitted acrylic textile material. It has an open top with a drawstring toggle closure. The holder is designed and used to provide the useful functions of organization, portability, storage, and protection to a cell phone. It measures approximately 2” (W) x 4” (L). In your letter you suggested classification under subheading 6307.90.9889, HTSUS, which provides for other made up articles of textile, other. However, the cell phone holder is akin to containers that are more specifically provided for in 4202, HTSUS. The applicable subheading for the cell phone holder will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change.
