Dear Ms. Ho: In your letter dated May 10, 2007, you requested a classification ruling. The submitted sample is a bandana made of woven 100% cotton fabric trimmed with glued on rhinestones and hemmed on four sides. The bandana is square and measures approximately 22 inches, which is less than 60 cm square. Chapter 62, Note 7 states “Scarves and articles of the scarf type, square or approximately square, of which no side exceeds 60 centimeters, are to be classified as handkerchiefs (heading 6213). Handkerchiefs of which any side exceeds 60 centimeters are to be classified in heading 6214.” The item will be classified as a handkerchief of heading 6213. The applicable subheading for the bandana will be 6213.20.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Handkerchiefs: Of cotton: Hemmed, not containing lace or embroidery.” The rate of duty will be 13.2% ad valorem. The textile category designation is 330. Duty rates are provided for your convenience and are subject to change.
