Handkerchiefs of which any side exceeds 60 centimeters are to be classified in heading 6214.

Dear Ms. Albatal: In your letter dated January 12, 2007, you requested a classification ruling. As requested, the samples will be returned to you. The submitted sample, Style #415544, are bandanas made of woven 100% cotton fabric. The bandanas are hemmed and measure approximately 54cm square and will be sold two in a package. Chapter 62, note 7 clearly states: Scarves and articles of the scarf type, square or approximately square, if which no side exceeds 60 centimeters, are to be classified as handkerchiefs (heading 6213). Handkerchiefs of which any side exceeds 60 centimeters are to be classified in heading 6214. The applicable subheading for the Style #415544 will be 6213.20.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Handkerchiefs: Of cotton: Hemmed, not containing lace or embroidery.” The duty rate will be 13.2% ad valorem. The textile category designation is 330. Duty rates are provided for your convenience and are subject to change.
