Dear Mr. Choe: In your letter dated March 20, 2007, on behalf of Tamex LLC, you requested a tariff classification ruling. As per telephone conversation with you, the sample will be retained by this office. Your submitted sample, style C8044-3-99 is a girl’s dress constructed of 100% cotton knit fabric. The dress has a scoop neck and short sleeves and imparts the visual impression of what appears to be a spaghetti strap jumper over a pullover. The dress has an empire waist, two large front buttons and a hemmed bottom. The pullover is stitched to the jumper and cannot be removed without damaging both garments. The applicable subheading for the dress will be 6104.42.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: dresses: of cotton: girls’. The rate of duty will be 11.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
