Dear Mr. Ramos: In your letter dated January 29, 2007, you requested a tariff classification ruling. A sample necklace was provided with your letter. The Sterling Silver Marcasite Necklace (PP 368543) is made of a 19-inch sterling silver chain with a teardrop cabochon genuine Jade surrounded by a swirl of marcasite pave. The earrings (368541) are of a similar construction. A value was not provided for either product. As you requested, the sample will be returned. The applicable subheading for the necklace and earrings, when valued not over $18 per dozen pieces or parts, will be 7113.11.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Articles of jewelry and parts thereof, of precious metal or of metal clad with precious metal: Of precious metal whether or not plated or clad with precious metal: Of silver, whether or not plated or clad with precious metal: Other, Valued not over $18 per dozen pieces or parts.” The rate of duty will be 13.5% ad valorem.
