Because the EZ Cleanze( is an irrigation nozzle system, it eliminates needle and syringe set-up, which eliminates needle risk and saves time.”

N004508 January 12, 2007 CLA-2-90:RR:E:NC:N1:105 CATEGORY: Classification TARIFF NO.: 9018.39.0050 Ms. Skye Wheeler SolvIT International 2160 Davcor Street SE Salem, Oregon 97302 RE: The tariff classification of an EZ Cleanze Nozzle from China Dear Ms. Wheeler: In your letter dated December 14, 2006, for PCS of Florida, Inc., you requested a tariff classification ruling. No sample was submitted. Per information attached, in a description by PCS distributed to potential purchasers, the EZ Cleanze: “Wound Irrigation Nozzle with Splashguard For use by Emergency Departments, Wound Care Centers, Urgent Cares and EMTs, the EZ Cleanze( wound irrigation nozzle fits standard saline bottles that are already in your hospital or medical center’s inventory… The EZ Cleanze( nozzle is sterile and individually packaged, and it occupies very little storage space. Because the EZ Cleanze( is an irrigation nozzle system, it eliminates needle and syringe set-up, which eliminates needle risk and saves time.” You state, “we ship the customer the nozzle in a sealed bag, non sterilized.” We understand you to mean that the items are imported non-sterile and are sterilized and packed sterile in the US. They are made of molded plastics and they do not contain a valve. The retail price is over $200 per hundred. Irrigation and wound washing syringes are noted in Harmonized System Explanatory Note I-A-16 to HS 9018 and this helps perform a like function. We agree that the applicable subheading for the EZ Cleanze Nozzle will be 9018.39.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other” Syringes, needles, catheters, cannulae and the like and parts and accessories thereof. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
