Dear Ms. Parker: In your letter dated October 18, 2006, you requested a classification ruling. The provided sample will be returned as per your request. Style 358843 is a pair of women’s pants constructed of 55% linen, 45% cotton woven fabric. The pants have a partially elasticized waistband with a drawstring, side seam pockets, two rear patch pockets, a fake fly, and hemmed legs. The applicable subheading for style 358843 will be 6204.69.9044, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s …trousers…: Other. The rate of duty will be 2.8% ad valorem. Duty rates are provided for your convenience and are subject to change.
