Five samples were submitted as follows: Style number 1110 is a man’s pair of ski/snowboard pants constructed of a shell composed of a woven 100% nylon fabric which has a visible polyurethane coating on the inner surface and sealed seams at the front and back rise. The garment is lined with a woven nylon fabric. The garment has an elasticized waistband with no opening, an elasticized drawcord tightening at the waist, a pocket with a zipper closure on the right thigh, a pocket with a flap secured by a hook and loop fastener on the left thigh, long hemmed legs with a scuff guard at the ankle, a vent opening with a gusset insert at the ankle area that is secured by a tab with a hook and loop fastener and hidden leg sleeves with an elasticized ankle cuff. Style 1111 is eligible for classification as water resistant. If the garment passes the water resistance test specified in the Harmonized Tariff Schedule of the United States (HTSUS), Chapter 62, U.S. Note 2, then the applicable HTS subheading for the garment will be 6203.43.3510, which provides for other: men’s or boys’ water resistant trousers or breeches: ski/snowboard pants: of synthetic fibers. The duty rate will be 7.1 percent ad valorem. If the garment does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6203.43.4010, which provides for other: men’s trousers and breeches: of synthetic fibers. The duty rate will be 27.9 percent ad valorem. Style 1211 is eligible for classification as water resistant. If the garment passes the water resistance test specified in the Harmonized Tariff Schedule of the United States (HTSUS), Chapter 62, U.S. Note 2, then the applicable HTS subheading for the garment will be 6204.63.3010, which provides for other women's or girls’ water resistant trousers or breeches: ski/snowboard pants: of synthetic fibers.
