The tariff classification of Christmas decorations from China.

Box 3165 Harrisburg, PA 17105 RE: The tariff classification of Christmas decorations from China. Dear Ms. Aldinger: In your letter dated April 26, 2006, you requested a classification ruling. The submitted sample is a 120MM Photo Frame Snow Globe, assortment number 945853. This item is a hand crafted water globe that can also hold a photo. It will be available in two assorted styles: Santa and Gingerbread figurines. The Santa water globe is designed with Santa, a decorated Christmas tree and presents inside the globe. The base of the water globe is fashioned with green garland that is decorated with red bows located at the upper portion. The lower base is decorated with various sizes of gift-wrapped presents all around the base. The gingerbread water globe is fashioned with a gingerbread boy and girl figures and other items inside the globe. The base is decorated with red and white candy canes, cookies, other candies and a decorated Christmas tree. The water globes are made in a manner that allows a picture frame to be inserted in the middle from the bottom and extend to the top of the globe. When the water globe is shaken, the artificial snow swirls around the figurines. The applicable subheading for the 120MM Photo Frame Snow Globes, assortment number 945853, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
