Box 1199 Williston, VT 05495 RE: The tariff classification of an apron from China. Dear Ms. Marcoux: In your letter dated April 28, 2006, you requested a classification ruling. The sample will be returned to you as requested. The submitted sample, style 54820, Flexi-Apron is made of woven polyester fabric with a metal wire. The garment covers the torso from the waist to below the knee and has a metal flexi-ring that adjusts to the waist and replaces the textile ties. The applicable subheading for style 54820 will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: Of man-made fibers: Other.” The duty rate will be 16% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
