Dear Ms. Marcoux: In your letter dated March 28, 2006 you requested a tariff classification ruling. The item in question is a portable battery operated radio (sample provided). It is designed as a vintage transistor AM/FM radio. It is denoted as model number 54260. The device is a fully functional radiobroadcast receiver capable of playing radio broadcasts. It operates completely on batteries, is valued under forty dollars, and does not contain a clock or clock timer.
