Dear Ms. Horn: In your letter dated April 5, 2006, on behalf of Pro Status, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample is a Work Vest constructed of knit 100% polyester fabric. The vest features cotton trim, deep V-neckline, oversize arm holes, left over right hook and loop closure, attached plastic name tag holder and two pockets at the waist. The applicable subheading for the Work Vest will be 6110.30.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other, other: vests, other than sweater vests: men’s or boys’. The duty rate will be 32 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
