Dear Ms. Mullineaux: In your letter dated March 10, 2006, on behalf of Bob Barker Company, Inc., you requested a classification ruling. The samples will be returned to you as requested. The submitted samples are a disposable top and pants made of non-woven, spun-bonded polypropylene textile fabric. The short sleeve pullover style top has a round neckline and extends to about the hip. The long pants have an elasticized waistband. The multi-purpose garments are used in correctional facilities. The applicable subheading for the disposable top and pants will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Garments, made up of fabrics of heading 5602, 5603, 5903,5906 or 5907: Of fabrics of heading 5602 or 5603: Other: Other, Other.” The duty rate will be 16% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
