GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In the case of style 311, the tunic imparts the essential character of the set.

Dear Ms. Salas Rogalski: In your letter dated December 7, 2005, you requested a classification ruling. As requested, the sample will be returned to you. Your submitted sample, style 311 El Diablo is a child’s costume set. The well-made costume is constructed of knit polyester fabric. The tunic-style shirt has styling features, a finished neck and well-made seams. The costume also features a plastic (vacuform) mask. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale.
