The samples you submitted are two sizes of containers that will be used to package cosmetics after importation (item number IRBPNTC2). The containers resemble paint cans in shape. The body of the containers is made of clear acetate. The base, lid, and wire handle are composed of steel. The smaller style is 5 inches in height and 3.5 inches in diameter. The larger style is 9 inches in height and 5 inches in diameter. The applicable subheading for the containers will be 7310.29.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for tanks, casks, drums, cans, boxes and similar containers, for any material…of iron or steel, of a capacity not exceeding 300 liters…of a capacity of less than 50 liters, other, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
