Dear Ms. Santos: In your letter dated March 16, 2005 you requested a tariff classification ruling. You submitted a sample with your request, which will be returned to you. The articles in question are various models of plastic spray bottles, identified as CVS item numbers 176705, 179043 and 176702. Item 176705 is a two-ounce plastic bottle with a push pump spray cap and a clear plastic cover for the spray pump. Item 179043 is a four-ounce trigger plastic spray bottle in three assorted styles, each style having a different shape and mold design. Item 176702 is an eight-ounce trigger plastic spray bottle in three assorted style shaped bottles. In operation item numbers 179043 and 176702 are activated by using a hand-operated plastic trigger. The trigger is depressed to spray a liquid. Item 176705 has a hand-operated pump, which is depressed to spray a liquid. The applicable subheading for the plastic spray bottles will be 8424.20.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for simple piston pump sprays. The rate of duty will be 2.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
