Dear Ms. Trimble: In your letter dated March 3, 2005, on behalf of Lingtex International, you requested a tariff classification ruling for a carrying bag. The sample submitted is identified as style 23206 B1 (23” x 20” x 6”) and 28206 Kak (28” x 20” x 6”), “PVC Zip Bag”. The item is a carrying bag similar to the travel bags of heading 4202 designed to provide storage, protection, organization and portability for personal effects. The intended use for the bag will be to transport/store throws, cushions and similar items. It is manufactured of clear heavy gauge polyvinyl chloride (PVC) plastic sheeting. The bag has wire reinforced seams and heavy braided top carrying handles. The applicable subheading for the carrying bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
