The garment features a flat waistband with four belt loops, a side zipper with two-button closure, a pleated front and back, and a hemmed bottom. The skit will be imported and sold with a polyester woven belt with a metal buckle. The trousers, shorts, skirt and belts of Styles 70540, 70530, 51700, 51710 & 1680 are considered to be composite goods, under the General Rules of Interpretation (GRI) 3(b). As such, they are classified as a unit under one tariff number, and one quota category number is applied to the trousers, shorts, skirts and belts. The essential character of these styles is imparted by the pants, shorts, and skirt. As noted above, Styles 70540, 70530, 51700 & 51710 have left over right closures. Chapter 62, note 8 states, in part: Garments of this chapter designed for left over right closure at the front shall be regarded as men's or boys' garments, and those designed for right over left closure at the front as women's or girls' garments. These provisions do not apply where the cut of the garment clearly indicates that it is designed for one or other of the sexes. As these garments have left over right closures, the presumption is that the garments will be for men. However, it is clear based on the cut of the garments that they were designed for women. Therefore, the pants will be classified as women’s garments. We are returning your samples as you requested.
