Pender Boullet Columbia Sportswear Company 14375 NW Science Park Drive Portland, OR 97229 RE: The tariff classification of a men’s jacket from Vietnam Dear Ms. Boullet: In your letter dated October 29, 2004, you requested a classification ruling. A sample was submitted and is being returned as you requested. The item in question, style HM7057, is a men’s upper thigh-length shirt-styled jacket with a shell made from a woven 66% cotton/34% nylon ripstop fabric weighing 212 grams per square meter. The garment has a full front opening with a covered five-button closure, a pointed collar, epaulets, bellows pockets with buttoned flaps in the chest, bellows pockets at the waist with a covered zipper closure (which may be replaced in production with a hook and loop type closure), side vents and long sleeves with a two-button tab at the wrist. The applicable subheading for the jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTS), which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles, of cotton. The duty rate will be 9.4 percent ad valorem. This jacket falls within textile category designation 334.
