They are as follows: Item 1001, described as “Molle Ammo Carrier”, is an ammo vest designed to wear for the convenience of holding firearm equipment and similar articles. Item 100123 is a drop leg configuration designed to be worn on the leg to contain pistol Megs, bullets and similar articles. Attached to the configuration is a removable pistol Meg pouch identified as item AC-0030 and handcuffs pouch identified as item AC-0029. The item measures approximately 10 ½”(W) x 9”(H). It is secured by means of a flap with hook and loop fastener in addition to a plastic slide lock fastener. Item 10012 – Al and AC-0026 are nylon pouches designed to be worn on the belt to hold bullets. The pouches measure approximately 9”(H) x 7”(W) and 6 ½”(W) x 8 ½”(H). Both items are secured by means of flaps with hook and loop fasteners.

Dear Ms. Chan: In your letter dated August 6, 2004, you requested a classification ruling. The samples submitted are identified as items 1001, 100123 and 10012, “Military Equipment Carriers”. Each item is specially fitted and designed to contain military equipment. The items are manufactured of man-made fiber textile materials. They are as follows: Item 1001, described as “Molle Ammo Carrier”, is an ammo vest designed to wear for the convenience of holding firearm equipment and similar articles. The duty rate will be 16 percent ad valorem. HTS 6211.43.0091 falls within textile category designation 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The applicable subheading for items100123 and 10012 will be 4202.92.9026, HTS, which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem. HTS 4202.92.9026 fall within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirements of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
