Dear Mr. Ashear: In your letter dated June 21, 2004 you requested a classification ruling. The sample will be returned to you as requested. The submitted sample, style GC444207 is a tubular scarf made of knit polyester fabric. The scarf measures approximately 48” in length and 5” wide. The ends of the scarf are sewn together at both ends. The applicable subheading for the scarf, style GC444207 will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing or accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: Shawls, scarves, mufflers, mantillas, veils and the like: Of man-made fibers, Other.” The rate of duty will be 11.3% ad valorem. There is no quota or visa on this merchandise. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
