Los Angeles, CA 90045 RE: The tariff classification of a girl’s capelet from China. Dear Ms. Antunes: In your letter dated March 12, 2004 you requested a classification ruling. The submitted sample style 50502 is a shawl like item. The capelet is made of open knitted 100% polyester fabric. The item has a partial opening and a tie closure. The capelet is sized 2T- 4T, 4 –6X and one size fits all. The item is designed to provide coverage to the shoulders, upper back and chest area as well as the upper arms, but does not extend to the abdomen area or waist. It is designed to be worn over other outerwear such as a blouse or shirt. The applicable subheading for style 50502 will be 6117.10.2030, Harmonized tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: Shawls, scarves, mufflers, mantillas, veils and the like: Of man-made fibers, Other.” The duty rate will be 11.3 percent ad valorem. The textile category designation is 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov.
