Dear Mr. Barnard: In your letter dated September 2, 2003, you requested a tariff classification ruling on behalf of Victoria’s Secret Direct. The provided sample is being returned as per your request. Style 170222 is a women’s racerback sports brassiere made with 2-ply construction throughout the garment. Both plies of the brassiere are made of a 92% nylon 8% spandex knitted fabric. The brassiere features a heavily elasticized bottom band measuring approximately 1-inch wide that is sewn into the bottom hem, a scoop front neckline, and capping at the arm openings. The applicable subheading for Style 170222 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 17 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
