La Cienega Blvd. #202 Los Angeles, CA 90045 RE: The tariff classification of a roof cargo carrier from China Dear Mr. Liu: In your letter dated June 4th, 2003 you requested a tariff classification ruling. The ruling is on behalf of Wal-Mart, K-Mart, and Car Wash stores. The sample submitted, identified as the “Roof Top Cargo Pack”, is a carrier designed to be affixed to a vehicle’s roof. It is constructed of man-made fiber textile. It measures approximately 49”L x 43”W x 6”H. There are eight webbed strips with molded plastic buckles connected to one side of the item. The applicable subheading for the carrier will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for other containers, with outer surface of textile materials or of sheeting of plastics, other. The rate of duty will be 17.8 percent ad valorem. Items classified in HTS 4202.92.9026 fall within category designation 670. Based upon international textile trade agreements, products of China are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
