Dear Ms. Laudano: In your letter dated May 30, 2003, you requested a tariff classification ruling. The submitted sample, item Admit One Code # 103050, is a sports brassiere constructed of a knitted 88% nylon 12% elastane fabric. The front panel is lined with a knitted 100% nylon fabric. The brassiere features a double pair of shoulder straps, one pair of which crisscross at the back. Additional features include a scooped neckline, elasticized capping at the top of the brassiere, a heavy elastic band measuring approximately ¾-inches wide sewn in the bottom hem, and “Admit One” printed at the center of the bust area. The applicable subheading for the brassiere will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 17 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
