Stile Associates Ltd. 181 South Franklin Avenue Valley Stream, N.Y. 11581 RE: COUNTRY OF ORIGIN MARKING OF IMPORTED TOTE BAGS OF TEXTILE MATERIALS; 19 CFR 134; Amendment to NY Ruling I87613. Dear Mr. Ortiz: This is in response to your letter dated March 13, 2003 requesting a clarification with regard to ruling I87613 concerning the marking requirements of certain tote bags. You have requested a clarification of the placement of the sewn-in fabric label bearing the English name of the country of origin. The request is on behalf of Kate Spade Inc. In the original ruling the placement of the sewn-in fabric label was described as follows: “ The placement of the sewn-in fabric label, as described, at a point not less than one inch from the top interior collar, would satisfy the requirements of the country of origin marking statute, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304). “ The pertinent phrase “… not less than one inch from the top interior collar…” is intended to mean not to exceed 1” down from the top collar of the bag. The purpose is that the label should be conspicuous to the ultimate purchaser. The original paragraph is amended to read: “The placement of the sewn-in fabric label, as described, at a point not to exceed more than one inch down from the interior top of the bag collar, would satisfy the requirements of the country of origin marking statute, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304).” This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR Part 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
