Tariff classification

HTS codes: 8441.30.0000

Headings: 8441

Product description

In your letter you described the spout inserter as a machine used in a packaging line where containers are filled with salt. The machine cuts strips of connected paper spouts into individual spouts, mechanically bends their wings, and pushes the spout into a pre-cut opening in the container. In a subsequent operation the container is then filled with salt.

CBP rationale

The applicable subheading for the spout insertion machine will be 8441.30.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other machinery for making up paper pulp, paper or paperboard…: machines for making cartons, boxes, cases, tubes, drums or similar containers, other than by molding.

NY I89755 February 3, 2003 CLA-2-84:RR:NC:1:103 I89755 CATEGORY: Classification TARIFF NO.: 8441.30.0000 Mr. John Sepela CSI International, Inc. 201 Hangar Road Avoca, PA 18641 RE: The tariff classification of a spout insertion machine from Italy Dear Mr. Sepela: In your letter dated January 9, 2003 on behalf of Morton Salt Company you requested a tariff classification ruling. The rate of duty will be free. Since it is not as specific a provision, your suggested classification of subheading 8441.80.0000, HTS, is not applicable. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
