Dear Ms Stahl: In your letter dated January 16, 2002, on behalf of Impact Products, LLC, you requested a tariff classification ruling for a drawstring spectacle pouch. The sample submitted is not identified by style number. The item is a drawstring pouch designed to contain a pair of “ProGuard®” safety glasses. It is manufactured with an exterior surface of 100% man-made textile materials. The pouch measures approximately 4”(W) x 7”(H). The applicable subheading for the spectacle pouch will be 4202.32.9550, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, other, other, of man-fibers. The rate of duty will be 18.1 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
