Dear Ms. Wallertz: In your letter dated January 14, 2002, you requested a tariff classification ruling. The provided sample will be returned as per your request. Style S02-06-024 is a women's T-back sports bra constructed of a 82% nylon 18% spandex knitted fabric. The bra features seamed and lined cups, an elasticized scooped neckline and arm holes, and a heavy elastic band sewn in the bottom hem. The applicable subheading for Style S02-06-024 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 17.1 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
