Dear Ms. Aldinger: In your letter dated December 31, 2001, you requested a tariff classification ruling. You are requesting the tariff classification on an item that is identified as item number 998171: Mask/Goggles/Snorkel/Fins Backpack. The package is comprised of the following components: plastic and rubber swim goggles, a plastic/rubber swim-mask, plastic/rubber swim fins, a snorkel and a vinyl and textile backpack. The applicable subheading for the backpack will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Trunks, suitcases, vanity cases, attache cases, briefcases, school satchels…knapsacks and backpacks…of sheeting of plastics…Other: Other.” The rate of duty will be 20 % ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
