Besler & Co. 115 Martin Lane Elk Grove Village, IL 60007-1309 RE: The tariff classification of a glass mirror and an agglomerated stone article from China Dear Ms. Dorfman: In your letter dated July 11, 2001, on behalf of your client, LTD Commodities, Inc., you requested a tariff classification ruling. Representative samples of the items were submitted and will be returned to you as requested. The submitted samples (identified as “EOR”) include a rectangular-shaped, framed glass mirror and a decorative agglomerated stone shelf. The reflecting surface of the mirror measures approximately six inches in length by five inches in width. The overall dimensions of the mirror (including the frame) are ten inches in length by nine inches in width. The dimensions of the shelf are ten inches in length by nine inches in width by three inches in depth. You stated in your letter that the frame of the mirror and the shelf are composed of natural stone powder agglomerated with plastic resin. Each item will be imported in two colors – gold and cream. The applicable subheading for the decorative framed glass mirror will be 7009.92.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass mirrors, whether or not framed, including rear-view mirrors: framed: not over 929 cm² in reflecting area. The rate of duty will be 7.8 percent ad valorem. The applicable subheading for the decorative agglomerated stone shelf will be 6810.99.0000, HTS, which provides for articles of…artificial stone, whether or not reinforced: other articles: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
