Dear Mr. Lum: In your letter dated July 3, 2001, you requested a tariff classification ruling. You are requesting the tariff classification on a product that is designed as a barrel plug for a paintball gun. The item is designated as item number JC-100. It is a regulation on all paintball fields that a paintball gun must be secured by a barrel plug or cover whenever the paintball gun is not on the playing field. The barrel plug is used to prevent an accident that may occur if a paintball is accidentally fired. The sample will be returned, as requested. The applicable subheading for the paintball gun barrel plug will be 9305.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Parts and accessories of articles of headings 9301 to 9304: Other: Of articles of subheading 9304.00.20 or 9304.00.40.” The rate of duty will be 3.9 % ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
