Dear Ms. Leach: In your letter dated March 26, 2001, you requested a tariff classification ruling. The submitted sample is a 12-inch tall pinecone topiary tree with a red and green fabric bow at the base of the tree. The tree portion is shaped with a 3-inch plastic ball that has been covered with real mini pinecones. The pinecones have been glued to the plastic ball. The stem is made of metal and the pot is made of earthenware. Pinecones are recognized motifs used as decorations for Christmas festivities. The applicable subheading for the pinecone topiary tree, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
