Dear Ms. Schramm: In your letter dated March 15, 2001, you requested a ruling on behalf of Lechters, Inc. on tariff classification. The sample you provided is a 13-piece cutlery set. The item number on the sample is 374-468. The set contains 6 steak knives, 1 pair of kitchen scissors, 1 paring knife, 1 boning knife, 1 utility knife, 1 carving knife, 1 chef’s knife and a wood storage block. All of the cutlery items have plastic handles. The applicable subheading for this product will be 8211.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for knives with cutting blades, serrated or not, sets of assorted articles. The general rate of duty will be the rate of duty applicable to that article in the set subject to the highest rate of duty. In this case, the rate of duty will be that of the scissors in heading 8213.00.9000, HTS, at 5.1 cents each piece plus 5.1 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
