Lauderdale, FL 33301 RE: The tariff classification of backpack from China. Dear Ms. Liu: In your letter dated February 12th, 2001, you requested a ruling on tariff classification. The sample submitted with your request is identified as item #C68F0300. The item is a backpack made of an exterior surface of 55% ramie and 45% polyester. The interior is unlined and consists of a single compartment with no additional features. The top opening is secured by a zippered closure. A zippered pocket is sewn to the front exterior and two shoulder straps are sewn to the rear exterior. The applicable subheading for this product will be 4202.92.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags…of vegetable fibers and not of pile or tufted construction, other. The general rate of duty will be 5.9 percent ad valorem. Items classifiable under HTS subheading 4202.92.2000 fall within textile category designation 870. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Your sample is being returned as requested.
