Dear Mr. Oun: In your letter dated February 2, 2001, you requested a tariff classification ruling. The submitted sample is a double baby bottle thermal carrier, identified as item #3366. The inside of the thermal holder is constructed of styrofoam material. The outside of the thermal carrier is covered with plastic sheeting with no textile backing and has a printed pattern. A plastic carry handle is affixed to the top and the bottle carrier has a zipper closure. The principal use of this holder is to carry two baby bottles. “The cooler is chiefly used to maintain beverage at a desired temperature over a period of time”. (SGI, INC. v United States). The applicable subheading for the double bottle thermal carrier will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles…of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
