Dear Ms. Kwok: In your letter dated November 22, 2000, you requested a tariff classification ruling. The sample submitted is a dog toy, item number C-59573. It is made of two layers of knit pile fabric designed in the shape of a bone. Between the layers of fabric are fiber filling and a squeaky device. The article is inserted through a plastic tube which depicts the face of a whimsical monkey and bananas. It measures approximately 9" x 4" at its widest points. The applicable subheading for the dog toy will be 6307.90.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other: Toys for pets, of textile materials. The rate of duty will be 6 percent ad valorem. The rate of duty effective January 1, 2001 will be 5.6 percent ad valorem. Merchandise from China classifiable under subheading 6307.90.7500, HTS, is not subject to countervailing duty or antidumping duty. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
