This letter replaces NY ruling F81737, dated February 22, 2000. In reviewing that letter a clerical error was identified in the textile category designation for style 9152. That clerical error has been corrected in the text below. Style 9129 is a pajama set consisting of a pullover top and a short pajama bottom made from 100% polyester charmeuse woven fabric. The top is sleeveless and has a V neckline. The pull-on shorts have a fully enclosed elasticized waistband. Style 9123 is a chemise made from 100% polyester charmeuse woven fabric. The garment extends from the shoulders to the mid-thigh; is cut full at the bottom; and has adjustable spaghetti straps that criss-cross in the back of the garment. Style 9153 is a sleep shirt made from 100% polyester georgette fabric. The garment features three-quarter length sleeves, a full front opening secured by six buttons and a hemmed bottom with side slits. Style 9151 is a bed jacket made from 100% polyester georgette woven fabric. The garment has long sleeves and ties in the front. Style 9152 is a long pajama pant made from 100% polyester georgette fabric. The pull-on bottom has a fully enclosed elasticized waistband. The applicable subheading for styles 9129, 9123 and 9153 will be 6208.22.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women's woven pajamas and nightdresses of man-made fibers. The duty rate will be 16.4 percent ad valorem. The applicable subheading for style 9152 will be 6208.92.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's woven sleep bottoms of man-made fibers. The duty rate will be 16.4 percent ad valorem. The applicable subheading for style 9151 will be 6208.92.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women' woven robes of man-made fibers. The duty rate will be 16.4 percent ad valorem. Styles 9129, 9123 and 9153 fall within textile category designation 651; style 9152 falls within textile category designation 652 and style 9151 falls within textile category designation 650. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
