Dear Ms. Gonzalez: In your letter, dated April 2, 2015, on behalf of your client, The TJK Companies, Inc., you requested a tariff classification ruling. The sample is being returned to you, as requested. Style AJ03415 is a women’s sleepwear top constructed of 45% cotton, 35% rayon and 20% polyester woven fabric. The fabric is lightweight french terry. The garment features: long sleeves, an attached hood, a deep V neckline opening secured by a crisscross tie, a kangaroo pouch pocket and a hemmed bottom. Although you have described the garment as sleepwear, their appearance is ambiguous and does not clearly demonstrate its use as such.
