Dear Ms. Edger: In your letter dated March 27th, 2000, on behalf of Binney and Smith Inc., you requested a tariff classification ruling. The sample submitted with your request, "Pouch, Oval, Vinyl", is a generic utility pouch manufactured of a transparent sheeting of Polyvinyl Chloride (PVC) that is 7 millimeters thick. The top opening is secured by a zip-around closure and a carry handle is permanently attached to the top of the bag. The interior consists of a single compartment with no additional features. You state the pouch will be filled after importation into the United States with markers, crayons, scissors, glue, and pencils and then sold at retail. The applicable subheading for "Pouch, Oval, Vinyl" will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags…other. The rate of duty will be 20% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
