As indicated by the submitted descriptive literature, the eyeglass holder, which will be sold under the name “MagnetMagic”, is designed to provide a holder for eyeglasses that can be used on outer apparel. It consists of a molded plastic “holder” piece that contains magnets. This piece is placed on a shirt, sweater, etc., and a metal backing plate is placed underneath the garment, creating a magnetic attraction and clamping the “holder” piece to the garment. The applicable subheading for the “MagnetMagic” eyeglass holder will be 8505.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other permanent magnets. The rate of duty will be 4.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
