Dear Mr. Rodriguez: In your letter dated March 13, 2000, you requested a tariff classification ruling. The subject merchandise, based on the information submitted, consists of the following plastic lamps: an electroluminescent night light, item number W-14-F-0051, that features an arch-shaped panel with plug for insertion into a wall socket. an electric night light, item number W-14-F-0226, that consists of a shade affixed to a small light fixture with bulb, plug and on-off light switch. The applicable subheading for these plastic night lamps will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings, other. The rate of duty will be 3.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
