We regret the delay in responding. The subject product, referred to by you as “Phosphomycin Sodium,” is the disodium salt of a naturally occurring antibiotic having the same United States Adopted Name (“USAN”) and International Nonproprietary Name (“INN”): Fosfomycin. It is indicated for use as an antibacterial drug. The applicable subheading for the subject product, imported in bulk form, will be 2941.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for "[A]ntibiotics: Other: Other: Other." The rate of duty will be free. This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
