Dear Mr. Zubok: In your letter dated January 20, 1999, you requested a tariff classification ruling. The subject item is described as aluminothermic chromium metal. In its imported condition, it will be a primary metal in lump form. The product will be used in foundry applications as an alloying agent. The chemical composition by weight is over 99% chromium with less than 1% of iron, aluminum, silicon and nitrogen. There are traces of other elements. Part of the processing of crushing it to size will be performed in a bonded warehouse in Rotterdam, Holland. The applicable subheading for the aluminothermic chromium metal will be 8112.20.6000, HTS, which provides for beryllium, chromium, germanium, vanadium, gallium, hafnium, indium, niobium (columbium), rhenium and thallium, and articles of these metals, including waste and scrap: chromium, other. The duty rate will be 3% ad valorem. This product does not qualify for special tariff treatment under the Generalized System of Preferences (GSP) because it is not imported directly from the beneficiary developing country (19 C.F.R. §10.175). This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
