Dear Ms. George: In your letter dated September 15, 1998 you requested a tariff classification ruling. The submitted sample, Style #EX 580/6 is a card with six pony tail holders consisting of braided 79% polyester/18% elastic/3% other. The articles at hand are not tightly braided and are colored. In order to be considered an article of twine, cordage or rope, it should be tightly plaited or braided and is usually uncolored. See EN Note (2) to heading 5607. The applicable subheading for the pony tail holders, Style #EX 580/6 will be 6217.10.8500, Harmonized tariff Schedule of the United States (HTS) which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Headbands, ponytail holders and similar articles." The rate of duty will be 15.1%. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
