Dear Mr. Hart: In your letter dated December 19, 1997, you requested a tariff classification ruling, on behalf of Bowen Thomas, Inc., your client. You are requesting the tariff classification on an item which is called a "Cumfy Dumfy". The item is a stuffed toy for young children. The item has a torso, arms, legs, and a face with eyes, nose, mouth, and hair. The toy represents a non-human creature with a smiling face. The outer shell of the item consists of 65 percent polyester and 35 percent cotton. It has an opening in the back of the torso secured by velcro that allows the filling (pillow) to be removed while washing the outershell. The item would be considered a toy, since its primary purpose is to serve as a source of amusement for children. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
