NY C82553 January 5, 1998 CLA-2-95:RR:NC:SP:225 C82553 CATEGORY: Classification TARIFF NO.: 9502.10.0060 Dawn Gentile 1310 East Grand Ave. El Segundo, CA 90245 RE: The tariff classification of Pewter Sports Champions from China Dear Ms. Gentile: In your letter dated December 1, 1997, received in this office December 10, 1997, you requested a tariff classification ruling on behalf of your client, Racing Champions. The submitted samples are all sports champions who have appeared on the cover of a national sports magazine. They are collectible human figures permanently affixed to a die-cast metal display stand which is permanent affixed to a plastic base with a large rectangular back piece. Inserted in the back piece is a copy of the cover of the national sports magazine. A plate on the front of the metal display stand gives the name of the sports figure and the date he was on the magazine cover shown, behind the figure. The figure and stand are packaged in a window box, with a certificate of authenticity. The figure is molded entirely of pewter and stands approximately three and a half inches in height on its base. As of the date of this letter, your client has four series each of which includes two sports figures: #1 Muhammad Ali and Frank Thomas #2 Ken Griffey Jr. and Joe Montana #3 Mickey Mantle and Brett Favre #4 Mario Lemieux and Emmitt Smith The six samples submitted from the first three series are returned as you requested. The classification of the comic book characters will be addressed in other ruling letters. The applicable subheading for all the Sports Champion figures noted above will be 9502.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressed, Other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
